The owner operates as an individual service provider of information society services as defined by the LSSI-CE.

2. Purpose of the website

Onion Podcasts (hereinafter, "the Platform") is a podcast hosting, distribution, and monetisation platform that enables:

• Creators to: upload and distribute audio content, manage paid subscriptions, offer premium content and exclusive extras, and receive payments through Stripe Connect.
• Listeners to: discover, follow, and listen to podcasts, subscribe to premium content, participate through comments and polls, and access public and private RSS feeds.
• Anonymous visitors to: browse and explore the public podcast catalogue without the need to register.

3. General terms of use

Access to and use of the Platform confers the status of user and implies full acceptance of these terms. The user undertakes to:

• Use the Platform in accordance with the law, morality, generally accepted good practices, and public order.
• Not use the Platform for unlawful purposes, purposes that are harmful to the rights and interests of third parties, or that may damage, disable, overload, or impair the Platform.
• Not introduce or disseminate computer viruses or any other systems liable to cause damage.
• Not attempt to access restricted areas of the Platform or accounts belonging to other users.
• Provide truthful and up-to-date information when registering.

4. Intellectual and industrial property

4.1. Ownership of the Platform

The source code, design, navigation structure, databases, graphics, icons, logos, and other elements of the Platform are the property of the website owner or its licensors, and are protected by intellectual and industrial property laws, including Royal Legislative Decree 1/1996, of 12 April (Consolidated Text of the Spanish Intellectual Property Act).

4.2. Creator content

Podcasts, episodes, audio files, images, and other content uploaded by creators are the property of their respective authors. The Platform does not acquire ownership of such content. Creators grant a limited, non-exclusive, and revocable licence to host, reproduce, and distribute their content in accordance with the Terms and Conditions of Use.

4.3. User content

Comments, votes, and other user contributions are the property of their authors. By publishing content, the user grants a non-exclusive licence for its display and distribution within the context of the service.

5. Limitation of liability

The owner shall not be liable, to the fullest extent permitted by applicable law, for:

• Damages arising from the lack of availability, continuity, or quality of the service, interruptions, or computer viruses.
• Content published by users or creators, who are solely responsible for such content.
• Damages arising from unlawful or improper use of the Platform.
• Damages arising from force majeure or circumstances beyond the owner's control.

The Platform acts as an intermediary service provider (Articles 13 to 17 of the LSSI-CE), with no general obligation to monitor the content it transmits or stores, without prejudice to its duty to cooperate with the competent authorities (Article 11 of the LSSI-CE).

6. Content policy

It is prohibited to publish, share, or distribute content that:

• Is illegal, defamatory, obscene, threatening, or that incites violence or discrimination.
• Infringes intellectual property rights, registered trademarks, or other third-party rights.
• Contains malicious software, viruses, or code designed to disrupt any system.
• Constitutes unauthorised advertising, spam, or unsolicited commercial content.
• Impersonates another person or entity.
• Violates the rights of minors.

The owner reserves the right to remove any content that contravenes these rules and to suspend or cancel offending accounts without prior notice.

7. Links to third-party websites

The Platform may contain links to third-party websites. Such links are provided for informational purposes only and do not imply the owner's approval of, or responsibility for, the content or practices of such websites.

8. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute, the user and the owner submit to the Courts and Tribunals of Palma de Mallorca (Illes Balears).

Where the user qualifies as a consumer under Royal Legislative Decree 1/2007 (TRLGDCU — Consolidated Text of the Spanish General Consumer Protection Act), the jurisdictional rules established in consumer protection legislation shall apply.
